Terms of Service

These Terms of Service ("Terms") govern your use of the BodySitRep application and website at bodysitrep.com ("Service"), operated by BodySitRep ("we", "our", or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please also review our Privacy Policy, which explains how we collect, use, and protect your data.

1. Acceptance of Terms

By accessing or using BodySitRep, you confirm that you are at least 13 years of age and that you accept and agree to be bound by these Terms. If you are using the Service on behalf of another person, you represent that you have authority to bind that person to these Terms.

2. Personal Use Only

BodySitRep is for personal health record-keeping only. It is not for professional, medical, legal, or commercial use without written permission from us.

3. Account Terms

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You agree to notify us immediately if you suspect unauthorized access.

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in abusive behavior, or if required by law. We will make reasonable efforts to notify you before or promptly after suspension, except where doing so would compromise security or violate legal obligations.

4. No Medical Advice

BodySitRep does not provide medical, legal, financial, or veterinary advice. The Service is not intended to diagnose, treat, cure, or prevent any disease or health condition. Users are solely responsible for health decisions. Always consult a licensed professional for medical guidance.

5. No Disability Claims

BodySitRep does not prepare, support, or guarantee documentation for any disability, benefits, or legal claim. BodySitRep is not affiliated with the U.S. Department of Veterans Affairs or any government agency.

6. Insight Disclaimer

BodySitRep may display analytics, trends, streaks, scores, and other calculated outputs based on data you enter. These outputs are for informational and personal awareness purposes only. They are not guaranteed to be accurate, complete, or clinically meaningful. Do not rely on these outputs for medical decisions.

7. User Responsibilities

You are responsible for the accuracy of the data you enter. You agree not to enter personal health information about another person without their informed consent. If you use caregiver features, you represent that you have legal authority or explicit permission from the person whose data you are recording.

8. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any applicable law.
Upload data about other people without their consent.
Attempt to access another user's account or data.
Scrape, crawl, or use automated tools to extract data from the Service.
Reverse engineer, decompile, or disassemble any part of the Service.
Interfere with or disrupt the Service, servers, or networks connected to the Service.
Use the Service to transmit malware, spam, or harmful content.
Resell, redistribute, or sublicense access to the Service.

Violation of these rules may result in immediate account suspension or termination.

9. Your Data

You own the data you enter into BodySitRep. We do not sell your data. You can export your data or delete your account at any time. For details on how we handle your data, see our Privacy Policy.

10. Billing and Subscriptions

BodySitRep offers subscription plans including Basic, Plus, Pro, and Caregiver tiers. Plan details and pricing are available on our Pricing page.

Free trial. The Basic plan includes a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and you will be charged for the first billing cycle.

Billing cycles. Subscriptions are billed on a monthly or yearly cycle, depending on the option you select at checkout. Billing is processed through Stripe. Your payment method will be charged at the beginning of each billing cycle.

Cancellation. You may cancel your subscription at any time from the Settings page in the app. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until your current period expires.

Refunds. Payments are non-refundable except where required by applicable law. If you believe you were charged in error, please contact us.

Price changes. We may change subscription pricing with at least 30 days notice. Price changes will apply at the start of your next billing cycle after the notice period.

11. Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We do not guarantee the accuracy or completeness of any data, analytics, or outputs generated by the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BODYSITREP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data, profits, or revenue.
Health decisions or outcomes based on information from the Service.
Service interruptions, downtime, or unavailability.
Unauthorized access to or alteration of your data.
Any third-party conduct or content.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless BodySitRep and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to:

Your use or misuse of the Service.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Your violation of any third party's rights.
Content or data you submit to the Service.

14. Changes to Service

We may modify, update, add, or remove features of the Service at any time without prior notice. We may also discontinue the Service entirely. If we discontinue the Service, we will make reasonable efforts to provide notice and allow you to export your data.

15. Changes to Terms

We may update these Terms at any time. We will post the updated Terms on this page and update the effective date. For material changes, we will make reasonable efforts to notify you through the app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Oklahoma. You consent to the personal jurisdiction of those courts.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BodySitRep regarding your use of the Service.
